Terms and conditions
1. Definitions
1.1 “Company” shall mean Feltus Electrical Pty Ltd its successors and assigns or any person acting on behalf of and with the authority of Feltus Electrical Pty Ltd.
1.2 “Customer” shall mean the Customer or any person acting on behalf of and with the written authority of the Customer.
1.3 “Work” shall mean all Works (including the supply of Materials) undertaken by the Company and described in this contract and includes any advice or recommendations.
1.4 “Materials” shall mean Materials required to complete the Works.
1.5 “Prime Cost Item” shall mean an item that either has not been selected, or whose Price is not known, at the time this contract is entered into and for the cost of supply and delivery of which the Company must make a reasonable allowance in the contract.
1.6 “Provisional Sum” shall mean an estimate of the cost of carrying out Works under this contract for which the Company, after making all reasonable inquiries, cannot give a definite Price at the time this contract is entered.
1.7 “Price” shall mean the Price of the Works as agreed between the Company and the Customer.
1.8 “Standard setting” shall mean a single brick veneer, single story home with gyprock walls internally and no insulation in the internal stud wall. Structure also being timber frame and either tin or tiled roof. Anything else outside of this scope mentioned is not standard and may attract additional charges to complete requested works.
2. General Terms and Conditions:
2.1 These terms and conditions ("Agreement") shall govern all services provided by Feltus Electrical Pty Ltd to its client/clients.
2.2 The Client acknowledges that by engaging the services of the Company, they agree to be bound by these terms and conditions, whether or not a written agreement is signed.
2.3 Any additional terms or conditions provided by the Client shall not be considered binding unless expressly accepted in writing by the Company.
2.4 None of the Company’s agents or representatives are authorised to make any representations, statements, conditions or agreements not expressed by the manager of the Company in writing nor is the Company bound by any such unauthorised statements.
2.5 Any instructions received by the Company from the Customer for the supply of Works and/or the Customer’s acceptance of Works undertaken by the Company shall constitute acceptance of the terms and conditions contained herein.
3. Services:
3.1 The Company agrees to provide electrical services as requested by the Client, subject to the terms of this Agreement.
3.2 The Company will exercise reasonable skill, care, and expertise in performing all services.
3.3 The Client acknowledges that any advice, recommendations, or instructions provided by the Company are based on the Company's professional judgment. The Client holds the Company harmless for any consequences resulting from the implementation of such advice or instructions.
3.4 All electrical installation work will comply with any amendments in force at the time of the works.
3.5 All electrical installation work will comply with applicable Building Regulations in force at the time of the works.
4. Installation Work
4.1 Where work is to extend or modify existing circuits, costs quoted assume that the existing installation is in adequate condition and complies with minimum current regulations. Any works found required to bring the necessary parts of the existing installation up to standard will be at additional cost.
4.2 Unless stated otherwise, all cables will be concealed by chasing into the building fabric or concealed in building voids, under floors, etc. Where impracticable, cabling will be neatly surface run, either clipping direct or housed in trunking / duct / conduit.
4.3 Where carpet or flooring coverings may require lifting to allow concealed installation work, additional charge may be made for this service and will be communicated prior to commencing, with best endeavours being made to avoid damaging them and to refit them to an acceptable standard. However, consideration of employing a specialist fitter may be prudent, at your cost to affect a fully satisfactory reinstatement.
4.4 Where agreed beforehand, chases to walls, etc will be re-filled to 2mm below plaster finish depth, however final finishing of skim coat plaster and final decoration is excluded. Where not previously agreed to, all patching will take place by you or your organised trade.
4.5 All endeavours will be made to undertake installation work to a clean standard.
4.6 The contract outlines the expected duration of the installation work.
4.7 Whilst undertaking the installation work at the property, the client is required to provide water and power free of charge
5. Client Obligations:
5.1 The Client shall provide accurate and complete information regarding their electrical requirements at the time of engagement.
5.2 The Client shall grant the Company reasonable access to the premises and electrical systems to perform the necessary services.
5.3 The Client is responsible for obtaining any necessary permits, approvals, or permissions required for the completion of the services.
5.4 Where more than one Customer has entered into this agreement, the Customers shall be jointly and severally liable for all payments of the Price.
5.5 Upon acceptance of these terms and conditions by the Customer, the terms and conditions are irrevocable and can only be rescinded in accordance with these terms and conditions or with the written consent of the Company.
6. Pricing, Payment and Variations:
6.1 The Company shall provide a detailed quote for the proposed services, including all associated costs, before commencing any work.
6.2 All figures quoted are valid for a date of 30 days from the date of the estimate or quotation
6.3 The Client agrees to pay the quoted price in full upon completion of the services, unless otherwise agreed upon in writing.
6.4 Any additional work not covered in our quoted costs will attract additional costs, If requested by the Client, the Company shall provide a revised quote, and any changes shall only be carried out upon acceptance by the Client.
6.5 Unless stated otherwise, the costs quoted assume standard working hours between the hours of 7:00am-4:30pm Monday-Friday. Work required outside these hours may attract out of hours rates.
6.6 The costs quoted assume continuous and unhindered access to the site by prior arrangement with you.
6.7 Unless agreed in writing, payment in full must be made on completion of the specified works to Feltus Electrical Pty Ltd. Stage payments will be requested by prior arrangement where planned works take longer than 30 days. We reserve the right to request from you stage payments in the instance where works take longer than 30 days, or where materials are to be purchased more then 14 days out from the booking date, to avoid potential price increases.
6.8 Late payment of any invoice may attract interest at a rate of 3% per month, compounded monthly, until payment is received in full.
6.9 All figures quoted are gst inclusive.
7. Work Site Access
7.1 We have based our offer on free and unrestricted access to all required work areas.
8. Liability and Insurance:
8.1 The Company shall maintain appropriate insurance coverage, including public liability insurance, to protect against any claims arising from its services.
8.2 The Company shall not be liable for any indirect, incidental, consequential, or punitive damages arising from its services, except where prohibited by law.
8.3 The Client shall indemnify and hold the Company, its employees, and subcontractors harmless from any claims, damages, or liabilities arising from the Client's breach of this Agreement or the Client's negligence.
9. Hazardous Materials
9.1 Unless specifically stated in this quotation, the quoted price is based on the assumption that the work for which this quotation is submitted will be executed in a hazardous material free environment. It is a strict condition of this quotation that the customer accepts full responsibility for the resolution of any problems and for delays and additional costs which may result from the presence of these materials in or about the site on which the works (or any part thereof) are to be performed.
10. Live Work Clause
10.1 It is our strict policy to only undertake live work or work near live conductors where it is safe to do so, particular emphasis is placed on: Compliance with AS/NZS 4836:2001 “Safe working on Low Voltage Electrical Installations, relevant Commonwealth and State Statutory Acts and Work Place Regulations”. Our live work procedure is designed to eliminate risk of injury to our employees, damage to your installations and unexpected power disconnections. The above may require us to disconnect or isolate parts of the installation to undertake such work for which additional charges may be applicable
11. Exclusions
11.1 Clearing and / or moving of furniture and other items blocking access to work areas are not included.
11.2 Except where detailed, builders work (creating of holes larger than 50mm diameter, creating of support structures, etc) are not included, except as outlined in 1d, e and f above.
11.3 Re-decoration and final making good is excluded from quoted costs, unless specifically detailed as included.
12. Confidentiality:
12.1 Both parties agree to keep confidential any proprietary or sensitive information received from the other party during the term of this Agreement.
12.2 This obligation of confidentiality shall survive the termination of this Agreement.
13. Termination:
13.1 Either party may terminate this Agreement by providing written notice to the other party, specifying the effective date of termination.
13.2 In the event of termination, the Client shall pay for all services rendered up to the effective date of termination.
14. Deviations from Building Regulations
14.1 All work where applicable, will be executed fully in compliance with applicable Building Regulations in force at the time of the work, particularly in respect of work in dwellings to allow the legal Part P obligations to be met. Where a Client requires deviation from such regulations, a written instruction and record will be required.
15. Risk and Title of Goods and Property
15.1 The risk in all goods supplied shall pass to the Client upon delivery.
15.2 All goods supplied shall remain property of Feltus Electrical Pty Ltd until all sums due have been paid in full.
15.3 The client is responsible for ensuring that the property is insured for the duration of the installation work.
16. Warrantee
16.1 Feltus Electrical Pty Ltd warrants its installation work to be defect free for a period of twelve months from invoice date. Such cover does not extend to goods not supplied by Feltus Electrical Pty Ltd physical damage to products, or any instance where the original installation has been altered or tampered by third parties.
17. Dispute Resolution
17.1 In the event of a dispute, mediation is to be the preferred method of resolution.
18. General
18.1 The customer shall make available to the Company personnel use of adequate site amenities at no cost to the Company.
18.2 The customer shall inform the Company personnel of:
a) general and specific safety requirements as and when they arise, in relation to the site; and
b) any incident or potential hazard that may cause harm to Company personnel.
18.3 The Company personnel shall present in Company corporate uniform whilst attending and working at the site.
18.4 The Company personnel shall, unless otherwise agreed, provide all necessary tools of trade for the carrying out and completion of work under the contract.
18.5 Wherever used in this contract; “contract price” shall mean the quoted price as varied; “materials” include consumables plant equipment and devices supplied in the course of the contract; the” Company” shall include entities related to Feltus Electrical Pty Ltd.
18.6 If any term or condition of this contract is found to be void it shall be excised without affecting the enforceability of the remaining terms or conditions.
